A traditional Chapter 11 to restructure a debtor’s business is nearly an extinct creature and has been replaced by the lightning speed of a “prepacked,” “prenegotiated” or “prearranged” Chapter 11 plan or, more frequently, a Bankruptcy Code “Section 363 sale” or quick liquidation. In this program, the speakers will discuss the reasons for the changes in chapter 11 practice, including the impact of the increased involvement of private equity and hedge funds in chapter 11 cases. The speakers will then discuss their impact on the steps creditors should be taking, both individually and through participation on a creditors’ committee, to assert control over the Chapter 11 process, enhance their recovery, minimize bankruptcy preference risk and exploit the Bankruptcy Code Section 503(b) (9) priority claim in favor of goods suppliers.

Bruce S. Nathan is a partner in Lowenstein Sandler’s Bankruptcy, Financial Reorganization & Creditors' Rights Department. He has over more than 35 years' experience in the bankruptcy and insolvency field, and is a recognized national expert on trade creditor rights and the representation of trade creditors in bankruptcy and other legal matters.
